II. Preparing representation for Audit objection and
/ Appeal and revision as stated in Chapter 15 (i) of Handbok2002.
Presently many exporters have received Audit objections
from Ministry of Finance and Office of Controller and Auditor
General of India.
Usual objections are recovery of Excess payments made
while approving erstwhile schemes like CCS / REP / SIL
/ ADVANCE LICENCE etc. We provide legal opinion and
legal services though our team of legal experts on the matter
related to Audit objections / ECA matters.
Further we undertake to evaluate Audit objections /
demands raised by related Departments from our Legal
team and prepare replies / attend the personal hearings
and represent cases effectively on merits / and on legal
grounds as laid down in current as well as old Export Import
Policy.
III. Import of items covered under Negative List
Scope of services:-
- Preparing application meticulously as per data received.
- Submission to Local Regional Licensing Authority.
- Subsequently submission to DGFT and relevant Department.
- Follow-up till you get the Licence in hand.
We require following documents for preparing application:-
- Copy of Proforma Invoice showing CIF value etc.
- Copy of RCMC.
- Copy of recommendation of recommending authority if
any.
- Copy of SSI / SIA Reg / ISO / Export House as applicable.
- End product to be manufactured with Licensed capacity.
- Details of past production of last 3 preceeding year.
- Details of Exports made in preceeding year.
- Justification of Import.
- Details of Licence obtained previously in past.
IV. Financial Assistance to Exporter "Market Development
Assistance" (MDA) Scheme
- Who is eligible for MDA ?
The exporters registered with Export Promotion Council
are eligible for MDA grant through respective Council.
However SSTH/STH/TH/EH are eligible for MDA grant through
FIEO.
- What is the procedure for applying MDA?
The exporter has to apply 14 days in advance before
the commencement of the journey with respective Council
in prescribed format.
- What is procedure for claiming MDA?
The exporter has to furnish his claim in the prescribed
proforma within 3 months of return to India after completion
and activity to the respective Council.
- How many tours are allowed in a financial year?
A maximum of Two Sales cum Study Tour and / or Participation
in Trade Fair / Exhibition in a financial year.
- Whether sales to a single country is allowed?
Yes, the tour to a single country or a group of companies
shall be with a minimum of four nights stay abroad excluding
journey period is allowed.
- How many participation in a particular trade
fair / exhibition are allowed?
A maximum of three participation in a particular trade
fair/exhibition would be eligible for MDA.
- Who is permissible for MDA?
Assistance shall be permissible to one regular employee
/ Director / Partner / Proprietor of the company.
- Whether the MDA for registration for bar coding
is allowed?
Yes MDA for registration for bar coding is allowed
through Ministry of Small Scale Industries, Office of
The Development Commissioner, Small Scale Industries,
Nirman Bhavan, New Delhi.
- How much assistance is allowed for registration
of bar coding?
For registration for bar coding Rs. 11,250/- is allowed
for SSI units. The grant reimbursed by the office of
Small Scale Industries, Nirman Bhavan, New Delhi.
- Whether the assistance is allowed for the cost
of acquiring ISO 9000 Certification?
Yes, the assistance is allowed. The exporter has to
furnish his claim with the office of the development
Commissioner, Small Scale Industries, Nirman Bhavan,
New Delhi.
- How much assistance is permissible?
75% of the amount spent for.
Special Package for SSI
- Funding Limits Permissible
(i) 90% of cost of return ticket by economy class subject
to an upper ceiling of Rs.60,000/- (Rs. 90,000/- for
Latin American Countries).
(ii) 25% of the cost of production of publicity material
limited to Rs.15000/- in a financial year.
Total MDA assistance under SSI / MDA Scheme shall
be inclusive of MDA assistance received from all bodies
- FIEO / EPC's / Commodity Board / Granted Organisation
etc.
Financial Assistance for the Conduct of Market Studies
Financial Assistance for the Conduct of Market Studies
would be available for the industry association EPCs/FIEO.
This will include studies commissioned by industry associations
to assess impact at WTO agreements on a specific sector.
The office of DC (SSI) may also commission such studies
independently under the scheme. Assistance for commissioned
studies would be limited to an overall ceiling of Rs.
2 Lakhs per day.
Financial Assistance for Anti-Dumping Cases
With opening up of the economy, the use of unfair trade
practices has come into sharper focus. Establishing
the use of unfair trade practices such as dumping requires
much ground work. Assistance for initiating / contesting
anti-dumping cases will therefore be made available
to SSI associations. Such assistance would be limited
to 50% of total cost involved or Rs. 1 lakh whichever
is lower.
